WA Supreme Court Hears Challenge To Massive Clean Energy Project

Nearly six years after plans were first unveiled, the controversial Horse Heaven Hills wind and solar project was back in court as the Washington Supreme Court heard arguments over one of the largest proposed clean energy developments in state history. Opponents, including Tri-Cities CARES, Benton County, and the Yakama Nation, argue state regulators and former Gov. Jay Inslee failed to adequately address concerns involving tribal interests, wildlife impacts, fire risks, community viewsheds, and property values.
Supporters of the project, including Colorado-based Scout Clean Energy, contend the proposal underwent one of the most extensive review processes in Washington history, generating more than 64,000 pages of records and years of public hearings, environmental reviews, and government consultations. Project developers argue opponents are seeking to stop the project entirely rather than improve it.
The proposed development would cover roughly 72,500 acres south of the Tri-Cities and originally included 244 wind turbines, large-scale solar arrays, and battery storage facilities. The outcome of the case could have significant implications for Washington's clean energy goals and future renewable energy projects statewide.
