A new debate over Title IX is unfolding after Defending Education called on the U.S. Department of Education to formally rescind the Biden administration's 2024 Title IX rule. The nonprofit organization argues the rule improperly expanded the definition of sex discrimination to include gender identity and sexual orientation under Title IX, the federal law governing sex discrimination in education programs receiving federal funding. The request follows a federal court ruling in 2025 that struck down the rule, finding the Department of Education exceeded its statutory authority by expanding protections beyond the language of the 1972 law.
