WA Supreme Court to Review Controversial Income Tax Repeal Disclosure

Washington's income tax repeal fight is heading back before the Washington State Supreme Court as justices reconsider a challenge to the controversial ballot disclosure that will accompany Initiative 645 in the November election. Government transparency advocate Arthur West is challenging the Public Investment Impact Disclosure, or PIID, written for Initiative 645, the Let's Go Washington-backed measure seeking to repeal Washington's newly enacted income tax. The disclosure tells Washington voters that passage of Initiative 645 would decrease funding for public K-12 education, higher education and human services, including healthcare. Critics argue that language is misleading because the new income tax has not yet generated revenue and money from the tax would not begin flowing into state coffers until 2029. West previously lost his PIID challenge in Thurston County Superior Court and appealed to the Washington State Supreme Court. After initially rejecting emergency relief amid concerns about ballot-printing deadlines, a panel of Supreme Court justices agreed to reconsider the matter. West says information obtained from multiple Washington county election offices shows ballot-printing deadlines extend into September, potentially leaving additional time for the courts to address the Initiative 645 disclosure. Meanwhile, a separate legal battle involving West and Washington GOP Chairman Jim Walsh is taking another unusual turn. West filed a defamation lawsuit against Walsh and the Washington State Republican Party after Walsh publicly criticized West's handling of the original PIID court challenge. Thurston County Superior Court Judge Chris Lanese—whose handling of the earlier ballot-language case had itself drawn criticism from Walsh—was initially assigned to the defamation lawsuit but has since recused himself. According to West, nearly all of Thurston County Superior Court's judges are now bowing out of the case, potentially requiring a visiting judge to hear West v. Walsh. The overlapping legal fights come as Washington voters prepare to decide Initiative 645 and the future of the state's new income tax in the November 2026 election.
