WA Press Credential Lawsuit Settled in Major Win for Independent Journalists

A major Washington press freedom lawsuit has reached a settlement in a legal battle over who qualifies as a journalist and who gets press access to state lawmakers at the Washington State Capitol in Olympia. Citizen Action Defense Fund announced a settlement involving the Capitol Correspondents Association in litigation brought on behalf of journalists Ari Hoffman, Jonathan Choe and Brandi Kruse. The case challenges Washington's press credentialing system and raises a fundamental First Amendment question: Who should decide which reporters and journalists receive access to lawmakers—the government, other members of the media, or neither? The controversy grew after journalists were denied press credentials or access to areas of the Washington State Legislature where reporters can directly question lawmakers. The lawsuit later entered discovery, giving plaintiffs access to internal communications surrounding the credentialing process. At a Seattle press conference announcing the settlement, Hoffman criticized what he said was behind-the-scenes scrutiny of journalists' political activity, social media, employers and other information as decisions were made about press access. Citizen Action Defense Fund Executive Director Jackson Maynard called the settlement a significant development for press freedom and argued that independent journalists, digital media, podcasters, radio hosts and other new-media reporters deserve First Amendment protections alongside traditional legacy news organizations. The Capitol Correspondents Association maintains that the Washington State House ultimately determines access to its chamber. CCA President Jerry Cornfield said the settlement affirms the association's position that the House determines access. While the settlement ends the dispute involving the Capitol Correspondents Association, the broader lawsuit is not over. The fight involving press access and the Washington State House continues, leaving unresolved a major question about who should control media credentials and journalist access inside the state Capitol.
