DESCRIPTION
A new Washington state initiative would expand the Public Records Act to the judicial branch, potentially changing the transparency requirements facing judges, courts and the Washington Supreme Court. Let's Go Washington has filed a new initiative to the Legislature focused on judicial transparency and public access to government records. The proposal would expand Washington's Public Records Act to include the state's judicial branch, including trial courts, the Washington Court of Appeals, Washington Supreme Court, judges, justices, clerks and other court personnel. Washington's Public Records Act currently does not apply to judicial records. Public access to court records and judicial administrative records is instead governed through court rules, including General Rule 31 and General Rule 31.1. Let's Go Washington argues that elected judges should face public accountability and transparency requirements comparable to other parts of state government. Founder Brian Heywood says the initiative is intended to establish a consistent transparency standard across Washington's executive, legislative and judicial branches. Heywood argues that the public should have greater access to information about how government officials conduct public business and make decisions. The initiative comes years after a Thurston County Superior Court ruling determined that the Public Records Act applies to the offices of individual Washington state legislators. The new judicial transparency initiative is still at the beginning of Washington's initiative process. According to the Washington Attorney General's Office, the proposal had not yet been transmitted to the office for preparation of a ballot title and was still undergoing review by the Code Reviser. If the proposal advances through the process and supporters collect enough valid signatures, the initiative to the Legislature could eventually be presented to Washington lawmakers during the 2027 legislative session. The Legislature could enact an initiative to the Legislature, decline to enact it and send the measure to voters, or approve an alternative that would appear alongside the original proposal. Today's Washington in Focus examines Let's Go Washington's new judicial transparency initiative, Washington's Public Records Act, public access to judicial records, the Washington Supreme Court, Brian Heywood and the continuing debate over government transparency and accountability in Washington state.
