Detransitioner Fights to Sue Doctors Over Gender Transition Treatment

Detransitioner Prisha Mosley is asking the North Carolina Court of Appeals to allow her lawsuit against doctors and other medical providers involved in gender transition treatment she received as a teenager to move forward. Mosley says she struggled with mental health problems and trauma as a teenager before encountering information about transgender identity online. According to Mosley, when she brought those feelings to medical providers, they affirmed her transgender identity and told her that gender transition was necessary to address the distress she was experiencing. Mosley says she began taking testosterone at age 17 and underwent a double mastectomy at age 18. She now says she regrets the transition and alleges the medical treatment caused lasting physical and emotional consequences. Those allegations remain part of ongoing litigation and have not been established as judicial findings against the medical providers. Mosley previously filed claims against doctors and other medical professionals involved in her treatment, but her case was dismissed because of legal time limits governing when the claims could be brought. She is now asking the North Carolina Court of Appeals to allow the lawsuit to proceed. Mosley argues that North Carolina legislation enacted after her original case was filed gives detransitioners additional time to pursue certain claims related to gender transition treatment and should allow her case to be reinstated. Her attorney, Troy Shelton, argued before the appeals court that patient health and safety should be a medical provider's first concern and characterized the treatment Mosley received as “ideology masquerading as medicine.” The North Carolina Court of Appeals must now determine whether the earlier dismissal of Mosley's case should stand or whether her lawsuit can move forward under the applicable state law.
