DESCRIPTION
The Supreme Court turns away 48 firearms cases without taking up a new Second Amendment case, while the Dec. 2 hearing on assault weapons bans remains the Court's major gun case this term.
Orders list: Following a long Friday conference, the Court released its orders list Monday, the opening day of the new term. According to the Duke Center for Firearms Law, the Court denied review in 48 firearms-related cases. Nine firearms cases remain pending, and updates could come with future orders lists.
Felon-in-possession challenges: Of the denied cases, 37 challenged the federal ban on felons possessing firearms. One of them left in place a Fifth Circuit ruling upholding the ban as applied to a man whose underlying offense was methamphetamine possession.
Out-of-state carry licenses: The Court also declined Johnson v. Jacobson, an Eighth Circuit case asking whether Minnesota must recognize carry licenses issued by other states. The case would have addressed the patchwork of state carry laws, which range from constitutional carry to permit-based systems.
What's still ahead: No new Second Amendment cases were granted, at least for now. The Court has three oral argument days in October and six in November, and conferences and orders lists could still add cases. On Wednesday, Dec. 2, the Court hears Montes v. Cook County and a companion challenge to Connecticut's gun ban.
