DESCRIPTION
Independent journalist Brandi Kruse has secured a major legal victory against the City of Seattle after the Washington State Supreme Court unanimously denied the city's request to review a public records ruling in her favor.
The decision marks a significant development in a years-long legal battle involving Seattle government transparency, Washington's Public Records Act, press freedom and taxpayer-funded litigation.
The dispute began in June 2023, when then-Seattle City Councilmember Andrew Lewis unexpectedly voted against legislation intended to strengthen enforcement against public drug use. Kruse filed public records requests seeking communications that could help explain his change in position.
According to the lawsuit, Seattle's handling of the requests delayed the release of records until after key election dates in 2023, raising questions about timely public access to government information.
After an initial defeat in King County Superior Court, Kruse and the Citizen Action Defense Fund prevailed before the Washington Court of Appeals, Division One. The City of Seattle then sought review by the Washington Supreme Court, which unanimously denied that request.
Jackson Maynard, executive director of the Citizen Action Defense Fund, celebrated the decision as a victory for journalists and citizens seeking to hold government officials accountable.
The case now returns to the trial court for further proceedings involving attorneys' fees and potential penalties under Washington's Public Records Act.
The legal battle also raises questions about how much Seattle taxpayers have spent defending the city's handling of public records requests.
